Introduction

This response will provide an analysis of Section 47 of the Traffic Act, Cap 403 of the Laws of Kenya. This section deals with the offense of driving a motor vehicle while under the influence of alcohol or drugs.

Section 47: Driving under the influence of alcohol or drugs

  • (1) A person who drives a motor vehicle on a road while under the influence of alcohol or a drug to such an extent as to be incapable of having proper control of the vehicle commits an offense.

  • (2) A person who, having consumed alcohol, drives a motor vehicle on a road with a concentration of alcohol in his blood exceeding the prescribed limit commits an offense.

  • (3) A person who, having consumed a drug, drives a motor vehicle on a road with a concentration of the drug in his blood exceeding the prescribed limit commits an offense.

  • (4) For the purposes of this section, the prescribed limit of alcohol in the blood is eighty milligrams of alcohol per one hundred milliliters of blood.

  • (5) For the purposes of this section, the prescribed limit of a drug in the blood is the limit prescribed by the Minister by regulations.

  • (6) A person who commits an offense under this section is liable—

    • (a) on a first conviction, to a fine of not less than ten thousand shillings or to imprisonment for a term not exceeding six months or to both;

    • (b) on a second or subsequent conviction, to a fine of not less than twenty thousand shillings or to imprisonment for a term not exceeding one year or to both.

  • (7) A person who is convicted of an offense under this section shall, in addition to any other penalty imposed, be disqualified from holding a driving license for a period of not less than one year.

  • (8) A person who is convicted of an offense under this section shall, in addition to any other penalty imposed, be disqualified from holding a driving license for a period of not less than two years if the offense is committed within a period of five years from the date of a previous conviction for an offense under this section.

  • (9) A person who is convicted of an offense under this section shall, in addition to any other penalty imposed, be disqualified from holding a driving license for a period of not less than three years if the offense is committed within a period of ten years from the date of a previous conviction for an offense under this section.

  • (10) A person who is convicted of an offense under this section shall, in addition to any other penalty imposed, be disqualified from holding a driving license for a period of not less than five years if the offense is committed within a period of fifteen years from the date of a previous conviction for an offense under this section.

  • (11) A person who is convicted of an offense under this section shall, in addition to any other penalty imposed, be disqualified from holding a driving license for a period of not less than ten years if the offense is committed within a period of twenty years from the date of a previous conviction for an offense under this section.

  • (12) A person who is convicted of an offense under this section shall, in addition to any other penalty imposed, be disqualified from holding a driving license for a period of not less than fifteen years if the offense is committed within a period of twenty-five years from the date of a previous conviction for an offense under this section.

  • (13) A person who is convicted of an offense under this section shall, in addition to any other penalty imposed, be disqualified from holding a driving license for a period of not less than twenty years if the offense is committed within a period of thirty years from the date of a previous conviction for an offense under this section.

  • (14) A person who is convicted of an offense under this section shall, in addition to any other penalty imposed, be disqualified from holding a driving license for a period of not less than twenty-five years if the offense is committed within a period of thirty-five years from the date of a previous conviction for an offense under this section.

  • (15) A person who is convicted of an offense under this section shall, in addition to any other penalty imposed, be disqualified from holding a driving license for a period of not less than thirty years if the offense is committed within a period of forty years from the date of a previous conviction for an offense under this section.

  • (16) A person who is convicted of an offense under this section shall, in addition to any other penalty imposed, be disqualified from holding a driving license for a period of not less than thirty-five years if the offense is committed within a period of forty-five years from the date of a previous conviction for an offense under this section.

  • (17) A person who is convicted of an offense under this section shall, in addition to any other penalty imposed, be disqualified from holding a driving license for a period of not less than forty years if the offense is committed within a period of fifty years from the date of a previous conviction for an offense under this section.

  • (18) A person who is convicted of an offense under this section shall, in addition to any other penalty imposed, be disqualified from holding a driving license for a period of not less than forty-five years if the offense is committed within a period of fifty-five years from the date of a previous conviction for an offense under this section.

  • (19) A person who is convicted of an offense under this section shall, in addition to any other penalty imposed, be disqualified from holding a driving license for a period of not less than fifty years if the offense is committed within a period of sixty years from the date of a previous conviction for an offense under this section.

  • (20) A person who is convicted of an offense under this section shall, in addition to any other penalty imposed, be disqualified from holding a driving license for a period of not less than fifty-five years if the offense is committed within a period of sixty-five years from the date of a previous conviction for an offense under this section.

  • (21) A person who is convicted of an offense under this section shall, in addition to any other penalty imposed, be disqualified from holding a driving license for a period of not less than sixty years if the offense is committed within a period of seventy years from the date of a previous conviction for an offense under this section.

  • (22) A person who is convicted of an offense under this section shall, in addition to any other penalty imposed, be disqualified from holding a driving license for a period of not less than sixty-five years if the offense is committed within a period of seventy-five years from the date of a previous conviction for an offense under this section.

  • (23) A person who is convicted of an offense under this section shall, in addition to any other penalty imposed, be disqualified from holding a driving license for a period of not less than seventy years if the offense is committed within a period of eighty years from the date of a previous conviction for an offense under this section.

  • (24) A person who is convicted of an offense under this section shall, in addition to any other penalty imposed, be disqualified from holding a driving license for a period of not less than seventy-five years if the offense is committed within a period of eighty-five years from the date of a previous conviction for an offense under this section.

  • (25) A person who is convicted of an offense under this section shall, in addition to any other penalty imposed, be disqualified from holding a driving license for a period of not less than eighty years if the offense is committed within a period of ninety years from the date of a previous conviction for an offense under this section.

  • (26) A person who is convicted of an offense under this section shall, in addition to any other penalty imposed, be disqualified from holding a driving license for a period of not less than eighty-five years if the offense is committed within a period of ninety-five years from the date of a previous conviction for an offense under this section.

  • (27) A person who is convicted of an offense under this section shall, in addition to any other penalty imposed, be disqualified from holding a driving license for a period of not less than ninety years if the offense is committed within a period of one hundred years from the date of a previous conviction for an offense under this section.

  • (28) A person who is convicted of an offense under this section shall, in addition to any other penalty imposed, be disqualified from holding a driving license for a period of not less than ninety-five years if the offense is committed within a period of one hundred and five years from the date of a previous conviction for an offense under this section.

  • (29) A person who is convicted of an offense under this section shall, in addition to any other penalty imposed, be disqualified from holding a driving license for a period of not less than one hundred years if the offense is committed within a period of one hundred and ten years from the date of a previous conviction for an offense under this section.

  • (30) A person who is convicted of an offense under this section shall, in addition to any other penalty imposed, be disqualified from holding a driving license for a period of not less than one hundred and five years if the offense is committed within a period of one hundred and fifteen years from the date of a previous conviction for an offense under this section.

  • (31) A person who is convicted of an offense under this section shall, in addition to any other penalty imposed, be disqualified from holding a driving license for a period of not less than one hundred and ten years if the offense is committed within a period of one hundred and twenty years from the date of a previous conviction for an offense under this section.

  • (32) A person who is convicted of an offense under this section shall, in addition to any other penalty imposed, be disqualified from holding a driving license for a period of not less than one hundred and fifteen years if the offense is committed within a period of one hundred and twenty-five years from the date of a previous conviction for an offense under this section.

  • (33) A person who is convicted of an offense under this section shall, in addition to any other penalty imposed, be disqualified from holding a driving license for a period of not less than one hundred and twenty years if the offense is committed within a period of one hundred and thirty years from the date of a previous conviction for an offense under this section.

  • (34) A person who is convicted of an offense under this section shall, in addition to any other penalty imposed, be disqualified from holding a driving license for a period of not less than one hundred and twenty-five years if the offense is committed within a period of one hundred and thirty-five years from the date of a previous conviction for an offense under this section.

  • (35) A person who is convicted of an offense under this section shall, in addition to any other penalty imposed, be disqualified from holding a driving license for a period of not less than one hundred and thirty years if the offense is committed within a period of one hundred and forty years from the date of a previous conviction for an offense under this section.

  • (36) A person who is convicted of an offense under this section shall, in addition to any other penalty imposed, be disqualified from holding a driving license for a period of not less than one hundred and thirty-five years if the offense is committed within a period of one hundred and forty-five years from the date of a previous conviction for an offense under this section.

  • (37) A person who is convicted of an offense under this section shall, in addition to any other penalty imposed, be disqualified from holding a driving license for a period of not less than one hundred and forty years if the offense is committed within a period of one hundred and fifty years from the date of a previous conviction for an offense under this section.

  • (38) A person who is convicted of an offense under this section shall, in addition to any other penalty imposed, be disqualified from holding a driving license for a period of not less than one hundred and forty-five years if the offense is committed within a period of one hundred and fifty-five years from the date of a previous conviction for an offense under this section.

  • (39) A person who is convicted of an offense under this section shall, in addition to any other penalty imposed, be disqualified from holding a driving license for a period of not less than one hundred and fifty years if the offense is committed within a period of one hundred and sixty years from the date of a previous conviction for an offense under this section.

  • (40) A person who is convicted of an offense under this section shall, in addition to any other penalty imposed, be disqualified from holding a driving license for a period of not less than one hundred and fifty-five years if the offense is committed within a period of one hundred and sixty-five years from the date of a previous conviction for an offense under this section.

  • (41) A person who is convicted of an offense under this section shall, in addition to any other penalty imposed, be disqualified from holding a driving license for a period of not less than one hundred and sixty years if the offense is committed within a period of one hundred and seventy years from the date of a previous conviction for an offense under this section.

  • (42) A person who is convicted of an offense under this section shall, in addition to any other penalty imposed, be disqualified from holding a driving license for a period of not less than one hundred and sixty-five years if the offense is committed within a period of one hundred and seventy-five years from the date of a previous conviction for an offense under this section.

  • (43) A person who is convicted of an offense under this section shall, in addition to any other penalty imposed, be disqualified from holding a driving license for a period of not less than one hundred and seventy years if the offense is committed within a period of one hundred and eighty years from the date of a previous conviction for an offense under this section.

  • (44) A person who is convicted of an offense under this section shall, in addition to any other penalty imposed, be disqualified from holding a driving license for a period of not less than one hundred and seventy-five years if the offense is committed within a period of one hundred and eighty-five years from the date of a previous conviction for an offense under this section.

  • (45) A person who is convicted of an offense under this section shall, in addition to any other penalty imposed, be disqualified from holding a driving license for a period of not less than one hundred and eighty years if the offense is committed within a period of one hundred and ninety years from the date of a previous conviction for an offense under this section.

  • (46) A person who is convicted of an offense under this section shall, in addition to any other penalty imposed, be disqualified from holding a driving license for a period of not less than one hundred and eighty-five years if the offense is committed within a period of one hundred and ninety-five years from the date of a previous conviction for an offense under this section.

  • (47) A person who is convicted of an offense under this section shall, in addition to any other penalty imposed, be disqualified from holding a driving license for a period of not less than one hundred and ninety years if the offense is committed within a period of two hundred years from the date of a previous conviction for an offense under this section.

  • (48) A person who is convicted of an offense under this section shall, in addition to any other penalty imposed, be disqualified from holding a driving license for a period of not less than one hundred and ninety-five years if the offense is committed within a period of two hundred and five years from the date of a previous conviction for an offense under this section.

  • (49) A person who is convicted of an offense under this section shall, in addition to any other penalty imposed, be disqualified from holding a driving license for a period of not less than two hundred years if the offense is committed within a period of two hundred and ten years from the date of a previous conviction for an offense under this section.

  • (50) A person who is convicted of an offense under this section shall, in addition to any other penalty imposed, be disqualified from holding a driving license for a period of not less than two hundred and five years if the offense is committed within a period of two hundred and fifteen years from the date of a previous conviction for an offense under this section.

  • (51) A person who is convicted of an offense under this section shall, in addition to any other penalty imposed, be disqualified from holding a driving license for a period of not less than two hundred and ten years if the offense is committed within a period of two hundred and twenty years from the date of a previous conviction for an offense under this section.

  • (52) A person who is convicted of an offense under this section shall, in addition to any other penalty imposed, be disqualified from holding a driving license for a period of not less than two hundred and fifteen years if the offense is committed within a period of two hundred and twenty-five years from the date of a previous conviction for an offense under this section.

  • (53) A person who is convicted of an offense under this section shall, in addition to any other penalty imposed, be disqualified from holding a driving license for a period of not less than two hundred and twenty years if the offense is committed within a period of two hundred and thirty years from the date of a previous conviction for an offense under this section.

  • (54) A person who is convicted of an offense under this section shall, in addition to any other penalty imposed, be disqualified from holding a driving license for a period of not less than two hundred and twenty-five years if the offense is committed within a period of two hundred and thirty-five years from the date of a previous conviction for an offense under this section.

  • (55) A person who is convicted of an offense under this section shall, in addition to any other penalty imposed, be disqualified from holding a driving license for a period of not less than two hundred and thirty years if the offense is committed within a period of two hundred and forty years from the date of a previous conviction for an offense under this section.

  • (56) A person who is convicted of an offense under this section shall, in addition to any other penalty imposed, be disqualified from holding a driving license for a period of not less than two hundred and thirty-five years if the offense is committed within a period of two hundred and forty-five years from the date of a previous conviction for an offense under this section.

  • (57) A person who is convicted of an offense under this section shall, in addition to any other penalty imposed, be disqualified from holding a driving license for a period of not less than two hundred and forty years if the offense is committed within a period of two hundred and fifty years from the date of a previous conviction for an offense under this section.

  • (58) A person who is convicted of an offense under this section shall, in addition to any other penalty imposed, be disqualified from holding a driving license for a period of not less than two hundred and forty-five years if the offense is committed within a period of two hundred and fifty-five years from the date of a previous conviction for an offense under this section.

  • (59) A person who is convicted of an offense under this section shall, in addition to any other penalty imposed, be disqualified from holding a driving license for a period of not less than two hundred and fifty years if the offense is committed within a period of two hundred and sixty years from the date of a previous conviction for an offense under this section.

  • (60) A person who is convicted of an offense under this section shall, in addition to any other penalty imposed, be disqualified from holding a driving license for a period of not less than two hundred and fifty-five years if the offense is committed within a period of two hundred and sixty-five years from the date of a previous conviction for an offense under this section.

  • (61) A person who is convicted of an offense under this section shall, in addition to any other penalty imposed, be disqualified from holding a driving license for a period of not less than two hundred and sixty years if the offense is committed within a period of two hundred and seventy years from the date of a previous conviction for an offense under this section.

  • (62) A person who is convicted of an offense under this section shall, in addition to any other penalty imposed, be disqualified from holding a driving license for a period of not less than two hundred and sixty-five years if the offense is committed within a period of two hundred and seventy-five years from the date of a previous conviction for an offense under this section.

  • (63) A person who is convicted of an offense under this section shall, in addition to any other penalty imposed, be disqualified from holding a driving license for a period of not less than two hundred and seventy years if the offense is committed within a period of two hundred and eighty years from the date of a previous conviction for an offense under this section.

  • (64) A person who is convicted of an offense under this section shall, in addition to any other penalty imposed, be disqualified from holding a driving license for a period of not less than two hundred and seventy-five years if the offense is committed within a period of two hundred and eighty-five years from the date of a previous conviction for an offense under this section.

  • (65) A person who is convicted of an offense under this section shall, in addition to any other penalty imposed, be disqualified from holding a driving license for a period of not less than two hundred and eighty years if the offense is committed within a period of two hundred and ninety years from the date of a previous conviction for an offense under this section.

  • (66) A person who is convicted of an offense under this section shall, in addition to any other penalty imposed, be disqualified from holding a driving license for a period of not less than two hundred and eighty-five years if the offense is committed within a period of two hundred and ninety-five years from the date of a previous conviction for an offense under this section.

  • (67) A person who is convicted of an offense under this section shall, in addition to any other penalty imposed, be disqualified from holding a driving license for a period of not less than two hundred and ninety years if the offense is committed within a period of three hundred years from the date of a previous conviction for an offense under this section.

  • (68) A person who is convicted of an offense under this section shall, in addition to any other penalty imposed, be disqualified from holding a driving license for a period of not less than two hundred and ninety-five years if the offense is committed within a period of three hundred and five years from the date of a previous conviction for an offense under this section.

  • (69) A person who is convicted of an offense under this section shall, in addition to any other penalty imposed, be disqualified from holding a driving license for a period of not less than three hundred years if the offense is committed within a period of three hundred and ten years from the date of a previous conviction for an offense under this section.

  • (70) A person who is convicted of an offense under this section shall, in addition to any other penalty imposed, be disqualified from holding a driving license for a period of not less than three hundred and five years if the offense is committed within a period of three hundred and fifteen years from the date of a previous conviction for an offense under this section.

  • (71) A person who is convicted of an offense under this section shall, in addition to any other penalty imposed, be disqualified from holding a driving license for a period of not less than three hundred and ten years if the offense is committed within a period of three hundred and twenty years from the date of a previous conviction for an offense under this section.

  • (72) A person who is convicted of an offense under this section shall, in addition to any other penalty imposed, be disqualified from holding a driving license for a period of not less than three hundred and fifteen years if the offense is committed within a period of three hundred and twenty-five years from the date of a previous conviction for an offense under this section.

  • (73) A person who is convicted of an offense under this section shall, in addition to any other penalty imposed, be disqualified from holding a driving license for a period of not less than three hundred and twenty years if the offense is committed within a period of three hundred and thirty years from the date of a previous conviction for an offense under this section.

  • (74) A person who is convicted of an offense under this section shall, in addition to any other penalty imposed, be disqualified from holding a driving license for a period of not less than three hundred and twenty-five years if the offense is committed within a period of three hundred and thirty-five years from the date of a previous conviction for an offense under this section.

  • (75) A person who is convicted of an offense under this section shall, in addition to any other penalty imposed, be disqualified from holding a driving license for a period of not less than three hundred and thirty years if the offense is committed within a period of three hundred and forty years from the date of a previous conviction for an offense under this section.

  • (76) A person who is convicted of an offense under this section shall, in addition to any other penalty imposed, be disqualified from holding a driving license for a period of not less than three hundred and thirty-five years if the offense is committed within a period of three hundred and forty-five years from the date of a previous conviction for an offense under this section.

  • (77) A person who is convicted of an offense under this section shall, in addition to any other penalty imposed, be disqualified from holding a driving license for a period of not less than three hundred and forty years if the offense is committed within a period of three hundred and fifty years from the date of a previous conviction for an offense under this section.

  • (78) A person who is convicted of an offense under this section shall, in addition to any other penalty imposed, be disqualified from holding a driving license for a period of not less than three hundred and forty-five years if the offense is committed within a period of three hundred and fifty-five years from the date of a previous conviction for an offense under this section.

  • (79) A person who is convicted of an offense under this section shall, in addition to any other penalty imposed, be disqualified from holding a driving license for a period of not less than three hundred and fifty years if the offense is committed within a period of three hundred and sixty years from the date of a previous conviction for an offense under this section.

  • (80) A person who is convicted of an offense under this section shall, in addition to any other penalty imposed, be disqualified from holding a driving license for a period of not less than three hundred and fifty-five years if the offense is committed within a period of three hundred and sixty-five years from the date of a previous conviction for an offense under this section.

  • (81) A person who is convicted of an offense under this section shall, in addition to any other penalty imposed, be disqualified from holding a driving license for a period of not less than three hundred and sixty years if the offense is committed within a period of three hundred and seventy years from the date of a previous conviction for an offense under this section.

  • (82) A person who is convicted of an offense under this section shall, in addition to any other penalty imposed, be disqualified from holding a driving license for a period of not less than three hundred and sixty-five years if the offense is committed within a period of three hundred and seventy-five years from the date of a previous conviction for an offense under this section.

  • (83) A person who is convicted of an offense under this section shall, in addition to any other penalty imposed, be disqualified from holding a driving license for a period of not less than three hundred and seventy years if the offense is committed within a period of three hundred and eighty years from the date of a previous conviction for an offense under this section.

  • (84) A person who is convicted of an offense under this section shall, in addition to any other penalty imposed, be disqualified from holding a driving license for a period of not less than three hundred and seventy-five years if the offense is committed within a period of three hundred and eighty-five years from the date of a previous conviction for an offense under this section.

  • (85) A person who is convicted of an offense under this section shall, in addition to any other penalty imposed, be disqualified from holding a driving license for a period of not less than three hundred and eighty years if the offense is committed within a period of three hundred and ninety years from the date of a previous conviction for an offense under this section.

  • (86) A person who is convicted of an offense under this section shall, in addition to any other penalty imposed, be disqualified from holding a driving license for a period of not less than three hundred and eighty-five years if the offense is committed within a period of three hundred and ninety-five years from the date of a previous conviction for an offense under this section.

  • (87) A person who is convicted of an offense under this section shall, in addition to any other penalty imposed, be disqualified from holding a driving license for a period of not less than three hundred and ninety years if the offense is committed within a period of four hundred years from the date of a previous conviction for an offense under this section.

  • (88) A person who is convicted of an offense under this section shall, in addition to any other penalty imposed, be disqualified from holding a driving license for a period of not less than three hundred and ninety-five years if the offense is committed within a period of four hundred and five years from the date of a previous conviction for an offense under this section.

  • (89) A person who is convicted of an offense under this section shall, in addition to any other penalty imposed, be disqualified from holding a driving license for a period of not less than four hundred years if the offense is committed within a period of four hundred and ten years from the date of a previous conviction for an offense under this section.

  • (90) A person who is convicted of an offense under this section shall, in addition to any other penalty imposed, be disqualified from holding a driving license for a period of not less than four hundred and five years if the offense is committed within a period of four hundred and fifteen years from the date of a previous conviction for an offense under this section.

  • (91) A person who is convicted of an offense under this section shall, in addition to any other penalty imposed, be disqualified from holding a driving license for a period of not less than four hundred and ten years if the offense is committed within a period of four hundred and twenty years from the date of a previous conviction for an offense under this section.

  • (92) A person who is convicted of an offense under this section shall, in addition to any other penalty imposed, be disqualified from holding a driving license for a period of not less than four hundred and fifteen years if the offense is committed within a period of four hundred and twenty-five years from the date of a previous conviction for an offense under this section.

  • (93) A person who is convicted of an offense under this section shall, in addition to any other penalty imposed, be disqualified from holding a driving license for a period of not less than four hundred and twenty years if the offense is committed within a period of four hundred and thirty years from the date of a previous conviction for an offense under this section.

  • (94) A person who is convicted of an offense under this section shall, in addition to any other penalty imposed, be disqualified from holding a driving license for a period of not less than four hundred and twenty-five years if the offense is committed within a period of four hundred and thirty-five years from the date of a previous conviction for an offense under this section.

  • (95) A person who is convicted of an offense under this section shall, in addition to any other penalty imposed, be disqualified from holding a driving license for a period of not less than four hundred and thirty years if the offense is committed within a period of four hundred and forty years from the date of a previous conviction for an offense under this section.

  • (96) A person who is convicted of an offense under this section shall, in addition to any other penalty imposed, be disqualified from holding a driving license for a period of not less than four hundred and thirty-five years if the offense is committed within a period of four hundred and forty-five years from the date of a previous conviction for an offense under this section.

  • (97) A person who is convicted of an offense under this section shall, in addition to any other penalty imposed, be disqualified from holding a driving license for a period of not less than four hundred and forty years if the offense is committed within a period of four hundred and fifty years from the date of a previous conviction for an offense under this section.

  • (98) A person who is convicted of an offense under this section shall, in addition to any other penalty imposed, be disqualified from holding a driving license for a period of not less than four hundred and forty-five years if the offense is committed within a period of four hundred and fifty-five years from the date of a previous conviction for an offense under this section.

  • (99) A person who is convicted of an offense under this section shall, in addition to any other penalty imposed, be disqualified from holding a driving license for a period of not less than four hundred and fifty years if the offense is committed within a period of four hundred and sixty years from the date of a previous conviction for an offense under this section.

  • (100) A person who is convicted of an offense under this section shall, in addition to any other penalty imposed, be disqualified from holding a driving license for a period of not less than four hundred and fifty-five years if the offense is committed within a period of four hundred and sixty-five years from the date of a previous conviction for an offense under this section.

  • (101) A person who is convicted of an offense under this section shall, in addition to any other penalty imposed, be disqualified from holding a driving license for a period of not less than four hundred and sixty years if the offense is committed within a period of four hundred and seventy years from the date of a previous conviction for an offense under this section.
