Introduction

This Release of Liability Waiver ("Waiver") is a legally binding agreement between [Name of Event Organizer], hereinafter referred to as "Organizer," and [Name of Participant], hereinafter referred to as "Participant." This Waiver outlines the terms and conditions under which Participant agrees to participate in the [Name of Event] ("Event").

Purpose of the Waiver

The purpose of this Waiver is to protect Organizer from liability for any injuries or damages that may occur to Participant during the Event. By signing this Waiver, Participant acknowledges and agrees to the terms and conditions set forth herein.

Scope of the Waiver

This Waiver applies to all aspects of the Event, including but not limited to:

Risks and Dangers

Participant acknowledges and understands that the Event involves inherent risks and dangers, including but not limited to:

  • Physical injury: The Event may involve strenuous physical activity, which could result in injuries such as sprains, strains, fractures, and concussions.

  • Medical emergencies: The Event may involve situations that require immediate medical attention, such as heat exhaustion, dehydration, or allergic reactions.

  • Weather conditions: The Event may be affected by weather conditions, such as rain, wind, or extreme temperatures, which could pose risks to Participant's safety.

  • Equipment failure: The Event may involve the use of equipment, which could malfunction or fail, resulting in injury to Participant.

  • Negligence of others: The Event may involve the actions of other participants, volunteers, or staff, which could result in injury to Participant.

Assumption of Risk

Participant expressly assumes all risks associated with the Event, including but not limited to those listed above. Participant understands and agrees that Organizer is not responsible for any injuries or damages that may occur to Participant during the Event, regardless of the cause.

Release of Liability

Participant hereby releases, discharges, and agrees not to sue Organizer, its officers, directors, employees, agents, volunteers, and representatives (collectively, "Released Parties") from any and all claims, demands, actions, causes of action, liabilities, losses, damages, costs, and expenses (including attorney's fees) of any kind or nature whatsoever, whether known or unknown, arising out of or in connection with Participant's participation in the Event, including but not limited to:

  • Personal injury: Any injury, illness, or death that may occur to Participant during the Event.

  • Property damage: Any damage to Participant's property that may occur during the Event.

  • Negligence: Any negligence on the part of the Released Parties.

  • Breach of contract: Any breach of contract by the Released Parties.

Indemnification

Participant agrees to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, demands, actions, causes of action, liabilities, losses, damages, costs, and expenses (including attorney's fees) arising out of or in connection with Participant's participation in the Event, including but not limited to those listed above.

Medical Treatment

Participant acknowledges and agrees that Organizer is not responsible for providing medical treatment to Participant during the Event. Participant is responsible for obtaining and paying for any medical treatment that may be necessary.

Governing Law

This Waiver shall be governed by and construed in accordance with the laws of the Republic of Kenya.

Severability

If any provision of this Waiver is held to be invalid or unenforceable, such provision shall be struck from this Waiver and the remaining provisions shall remain in full force and effect.

Entire Agreement

This Waiver constitutes the entire agreement between the parties with respect to the subject matter hereof and supersedes all prior or contemporaneous communications, representations, or agreements, whether oral or written.

Waiver of Jury Trial

Participant hereby waives any right to a jury trial in any action or proceeding arising out of or relating to this Waiver.

Notices

All notices and other communications hereunder shall be in writing and shall be deemed to have been duly given when delivered personally, sent by certified or registered mail, return receipt requested, postage prepaid, or sent by overnight courier service, addressed as follows:
